Terms & Conditions
Last Updated: August 28, 2026
Welcome to BroTaco. These Terms & Conditions (“Terms”) govern your access to and use of the BroTaco website at www.brotaco.co (the “Site”), including any contact forms, catering inquiries, online ordering links, promotions, social-media links, and other services made available through the Site.
By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. About BroTaco
BroTaco is a food-service business serving Texas BBQ brisket tacos and related menu items in Texas.
Phone: (254) 284-7857
Website: www.brotaco.co
2. Use of the Site
You may use the Site only for lawful, personal, and non-commercial purposes, including:
-
Viewing our menu, hours, location, and business information.
-
Contacting us with questions or service requests.
-
Requesting catering information or submitting an event inquiry.
-
Accessing authorized ordering, delivery, reservation, or social-media services linked from the Site.
You agree not to:
-
Use the Site in violation of any applicable law or regulation.
-
Attempt to interfere with the operation, security, or accessibility of the Site.
-
Upload, submit, or transmit harmful code, spam, malicious content, or unauthorized advertising.
-
Copy, reproduce, modify, sell, distribute, or exploit Site content without our prior written permission.
-
Use our name, logo, photographs, menu descriptions, or other content in a misleading manner.
-
Impersonate BroTaco, an employee, another customer, or any other person or business.
We may suspend or limit access to the Site at any time if we reasonably believe these Terms have been violated.
3. Menu, Pricing, and Availability
We work to keep the information on the Site accurate, but menu items, ingredients, prices, photos, portions, specials, hours, and availability may change at any time.
Menu photos are for general illustration and may not exactly represent the item served. Prices shown online may differ from in-person, delivery-platform, catering, tax-inclusive, or promotional pricing. Taxes, service fees, delivery fees, third-party platform fees, and gratuities may apply where applicable.
We reserve the right to correct errors, update information, change pricing, substitute ingredients when appropriate, limit quantities, or discontinue an item without prior notice.
4. Food Allergies and Dietary Needs
BroTaco prepares food in a commercial food-service environment that may handle ingredients including, without limitation:
-
Milk and other dairy products.
-
Eggs.
-
Wheat and gluten.
-
Soy.
-
Peanuts and tree nuts.
-
Fish and shellfish.
-
Sesame.
-
Other potential allergens.
Although we take food preparation seriously, we cannot guarantee that any menu item is completely free from allergens, gluten, cross-contact, or cross-contamination. Customers with food allergies, sensitivities, dietary restrictions, or medical conditions should contact us before ordering and inform staff of their needs.
You are responsible for deciding whether a food item is appropriate for your dietary needs. BroTaco does not guarantee allergen-free, gluten-free, vegetarian, vegan, or other specialty dietary preparation unless we specifically confirm it in writing.
5. Catering Inquiries and Event Services
Submitting a catering form, inquiry, request for information, or request for a quote does not create a binding catering agreement, reserve a date, or guarantee availability.
A catering booking is confirmed only when BroTaco provides written confirmation and any required contract, deposit, payment, or other booking requirement has been completed.
Catering terms may vary by event and may address items such as:
-
Guest count and menu selections.
-
Event date, service time, and location.
-
Deposit and payment deadlines.
-
Travel, staffing, setup, cleanup, rentals, or service charges.
-
Final guest-count deadlines.
-
Cancellations, postponements, refunds, and weather-related changes.
-
Venue access, power, water, parking, permits, and site requirements.
-
Customer responsibilities and event-specific food-service arrangements.
If a separate written catering agreement conflicts with these Terms, the catering agreement controls for that event.
6. Orders and Third-Party Services
The Site may contain links to third-party services, including online-ordering providers, delivery platforms, mapping services, payment processors, social-media platforms, and other websites. Those third parties operate independently and have their own terms, privacy policies, fees, availability, and customer-service procedures.
BroTaco is not responsible for the content, practices, accuracy, availability, security, or performance of third-party websites or services. Your use of any third-party service is governed by that provider’s applicable terms and policies.
If an order is placed through a third-party ordering or delivery service, issues related to delivery timing, driver conduct, platform charges, account access, or payment processing may need to be addressed with that provider. BroTaco will still make reasonable efforts to help resolve concerns involving food prepared directly by us.
7. Payments, Refunds, and Order Issues
Payment requirements, accepted payment methods, refunds, cancellations, and order-change policies may vary depending on whether you order in person, through BroTaco, through a third-party service, or through a catering agreement.
Please review your order before completing payment. If there is a problem with an order, contact BroTaco as soon as reasonably possible and keep the order receipt or confirmation available. We may request details, photographs, or other information needed to review the issue.
Nothing in these Terms requires BroTaco to issue a refund where one is not legally required or where an issue resulted from customer error, failure to communicate dietary needs, delayed pickup, misuse of food after pickup or delivery, or circumstances outside our reasonable control.
8. Intellectual Property
The Site and its contents—including the BroTaco name, logos, branding, menu descriptions, text, graphics, photographs, videos, design, layout, and other materials—are owned by or licensed to BroTaco and are protected by applicable intellectual-property laws.
You may view and print Site content for personal, non-commercial use only. You may not use, reproduce, republish, distribute, alter, create derivative works from, or commercially exploit our content without prior written permission from BroTaco.
9. User Submissions
If you submit information through the Site, including a contact request, catering inquiry, feedback, review, photograph, message, or other content, you represent that the information is accurate and that you have the right to provide it.
You agree not to submit content that is unlawful, defamatory, threatening, obscene, discriminatory, infringing, misleading, or otherwise inappropriate.
Unless otherwise agreed in writing, you grant BroTaco a non-exclusive, royalty-free right to use feedback, testimonials, reviews, and other non-confidential submissions for business and promotional purposes. We will not publish personally identifying information in a testimonial without appropriate permission.
10. Disclaimer of Warranties
The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, BroTaco makes no warranties, express or implied, regarding the Site, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.
We do not guarantee that the Site will always be available, error-free, secure, complete, current, or free from viruses or harmful components.
11. Limitation of Liability
To the fullest extent permitted by applicable law, BroTaco and its owners, employees, contractors, agents, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, or inability to use, the Site or any linked third-party service.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
12. Indemnification
You agree to defend, indemnify, and hold harmless BroTaco and its owners, employees, contractors, agents, and affiliates from claims, losses, liabilities, damages, costs, and expenses—including reasonable attorneys’ fees—arising from your violation of these Terms, misuse of the Site, or violation of another person’s rights.
13. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Any dispute arising from or related to these Terms or the Site will be brought in a court with proper jurisdiction located in or serving Coryell County, Texas, unless applicable law requires otherwise.
14. Changes to These Terms
BroTaco may revise these Terms at any time. The revised version will be posted on this page with an updated “Last Updated” date. Your continued use of the Site after changes are posted means you accept the revised Terms.
